In 2015, Naomi Mondesir was placed in scalding hot water by her nurse, Oluyemisi Adebayo, an LPN employed by Harry’s Nurses Registry, Inc. The burns, which covered approximately 50% of Naomi’s body, led to complications including pneumonia, sepsis, and her death six days later.
Naomi’s grieving mother, Cynthia Mondesir, initially sought representation from the law firm Shaevitz & Shaevitz. However, she was allegedly coerced into switching her representation to Tarshis & Hammerman, LLP. During their three-month involvement in the case, Tarshis & Hammerman’s only notable contribution was filing and serving the summons and complaint.
The crux of the controversy surrounds Adebayo’s insurance provider, who tendered their $500,000 policy in late February 2017 after extended negotiations. However, the spotlight is on Harry’s Nurses Registry’s insurance provider, AIG, which is alleged to have colluded with Tarshis & Hammerman, LLP. Accusations suggest that AIG never paid the money to Cynthia Mondesir, but instead unjustly and fraudulently increased the insurance premium for Harry’s Nurses Registry.
